Also to add, I did enter UK back on 10/01/2011 on Tier 2 (G) which is less than 28 days from the expiry date (15/12/2010) of previous Tier 2 (ICT)....

I got following response from UKBA (against a FOI):

"If the person has been granted an Entry Clearance Visa before their previous leave to remain expired, the period will be considered as continuous period."

and on that basis, I believe I should qualify. Am I missing something?
Home office should have curtailed your ICT leave as you're no longer working in the UK for your previous employer. So in that scenario, your visa validity until 15/12/2010 could be irrelevant.

Thanks. Appreciate your response. For my awareness - How would home office know about it? Moreover I always planned to come back within 28 days, but unexpected circumstances delayed it further.
