Spouse Settlement Visa From India

Post by diversity » Mon Aug 04, 2014 2:52 pm

Hi Friends,

After taking extraordinary help from the forum for my immigration journey, I am back here for my wife's visa:

Married earlier 2011 , divorced in 2013 married in May 2014. Divorce through a family court.

I now looking to apply for the spouse visa. Below is the documentation I am submitting:

1. VAF4A Application form
2. Appendix 2 form
3. Sponsorship undertaking form
4. UKBA Online application printout with passport photograph
5. Wife - TB test results
6. Wife - Academic Transcripts for 3 years and letter from University that degree was taught in English
7. Wife - NARIC letter comparability Assessment
8. Wife - Passport
9. Marriage certificate & Divorce Certificate (Mine)
10. Marriage Album (of about 12 photos covering various parts of the wedding)
11. Marriage invitation
12. Mine - 12 months current account bank statements
13. Mine - 12 months savings account statements
14. Mine - 12 months attested payslips
15. Mine - Tenancy Agreement + Letter from Lanlord
16. Mine - Utility bills (1 council tax statement + 1 Gas bill)
17. Mine - British Passport copy+copy of my Indian passport (I got married before I Naturalized & got my passport)
18. Mine - Employer letter (confirming employment status, start of employment and salary)
19. Mine - P60 for 2014
20. Gtalk scan - just one scan to show us chatting, Whatsapp Chats prints
21. Lyca printout for last six months to show phone calls
22. Covering letters for wife and me (each clearly stating what they are producing as evidence for the application as per above)

On the online form, for the question how is the sponsor related to you, there is no option for spouse / husband, what should I select "other relative".
Also my wife currently not working, should I say supported by spouse / unemployed

Can you guys let me know if the documentation sufficient and also the response for the relatioship question... :D :D :D

Hi , I'm also waiting for the visa status from my wife . and I got a reply from UKVISA saying
"We understand that you would like to know about the current status of your
visa application. I have tracked the status (GWF*********** and date of birth
************) and found that a decision on your application has been delayed
whilst further enquiries are being conducted. Your visa application centre
or the entry clearance officer will contact you once a decision has been
made or, if necessary, during the consideration of your application."

. So , you also got the same reply when your wife visa status is in progress. or different message.?

First and foremost you need to meet the financial (£18,600) and english requirements for your wife. The financial requirements includes 6-months bank statements and 6-months payslips. You wife must pass the english exam. Since your wife does not live in the UK at the moment am afraid she cannot use form FLRM, but i think she can use form VAF4A and please fill out Appendix-2 as directed in the application form. Please follow the link below;

https://www.gov.uk/government/uploads/s ... /VAF4A.pdf

https://www.gov.uk/government/uploads/s ... endix2.pdf

https://www.gov.uk/government/uploads/s ... lement.pdf

You should complete Appendix 2 if you wish to come to the UK as:
• The spouse or civil partner of someone settled in the UK; or
• The child of a parent who is applying for entry clearance as a partner or the child who is applying to join their parent who is already in the UK and has been granted limited leave as partner granted under the Immigration Rules in force on 09 July 2012; or
• The fiancé(e) or proposed civil partner of someone settled in the UK; or
• The unmarried or same sex partner of someone settled in the UK; or
• The Post Flight family member (spouse or civil partner, unmarried or same-sex partner, fiancé(e) or proposed civil partner, or child) of someone with limited leave to enter or remain in the UK as a refugee or is the beneficiary of humanitarian protection.

Hope this helps :D Other experienced members please give your advise to Ima. Thanks
Dear Spatacus,

Thank you for your quick response, much appreciated. Unfortunately, I don't fulfill the first criteria of earning £18,600 per year however, the firm I am currently working with will offer me a new contract beginning from 5th of January which will hopefully see me meeting the financial requirement of £18,600. Till date I have been earning less than £18,600 and that too on a contractual basis and not permanent.

Once my new contract is set up, hopefully I will have 6 months of payslip and bank statements showing funds by 1st week of July. I shall also be able to arrange contract letter from employer and accommodation letter from the landlord.

Which English test should she take, IELTs, Toefl amd what's the minimum band required?
Do I have to attach her Educational documents as well?
Do you know what's the average time scale for such applications thesedays?

My understanding was that I would be the only one filling out the form and submitting the application from UK but little confused about her being required to fill out form too from back home. Are we supposed to submit separate applications from within UK and from back home? Please advise.

I'm really grateful for your time and responses.

Many thanks,

Ima
Hello Ima,
you will have to submit your wife's application from your home country since she doesn't live in the UK. You will include your marriage certificate as well as the English language requirements check the links I sent you on documents required for the application you will find the English language requirements and the type/band required.
You only need to submit ONE application only and this is to be submitted in the country your wife is currently residing.
Dear Spatacus,

Thank you for further clearing my doubts. I have created a checklist of the documents for myself and my wife. Please confirm if I'm missing anything

My Documents:

- Appendix 2 (VAF 4A) Financial Requirement Form
- 6 Months Payslip - showing I earn £18,600 per annum
- 6 Months Bank Statements
- Employers Letter - is it mandatory?
- Letter from Landlord confirming there is enough space to accommodate?
- Marriage Certificate
- Wedding Pictures

My Wife Documents:

- Personal Details Form (VAF 4A) Family Settlement Application Form
- All her Passports
- Two Passport size pictures
- English Test Certificate - CEFR A1 level 1 or equivalent
- TB Test Report
- Degree Certificate - is it mandatory?

My wife applied on 25/08/14 and BHC got it a day after.
It has been over 30 days and my wife was told by VFS staff that she will hear in 28 days.
We have heard nothing. I hope to hear soon.
I am worried as I changed job on 1st sept and secured a civil service job but I met the conditions prior to joining this job and have provided them with 6 months of payslips.
I called before I applied and UKVI advised that it should be fine for me to apply. Since the submission of application, I have called them 3 times and all I am told is that it is under the process. I am getting really anxious now.

Can someone kindly clarify on the english language requirement please ? the guide says an approved english test or degree taught in english.....would confirming the degree and english language using the pbs calculator be sufficient evidence to prove english skills.

Cheers,
Shiva
