Indefinate For Spouse Of Long resident ILR Holder?

Post by mahee55 » Sun Jun 01, 2014 7:39 pm

Dear All
I got my ILR few months ago. My wife got 2 year visa through FLR M. I got my ILR through 10 year long residency through Tier 4 and PSW visa. Now my question is that when can my wife who joined me in UK in 2009 apply for ILR?
Someone told me she can apply for ILR straight away through SET(M), is this right?

Any advise will be appreciated.

Regards

When did your spouse actually apply for FLR(M), the exact date and was she granted leave to remain for 2 or 2.5 years?

Then assuming she's been in the UK two years she may apply for SET(M) now by virtue of 287(a)(i)(d), B1 English and LIUK required.

She can apply for ILR after 5 years on FLR(M), the rules changed in April 2014. She can also apply on the basis of 10 years long residence when she reaches that in 2018.
