Naturalisation after ILR - 12 months?

Hello All,

Some postings here states that 12 months period required after ILR, in order to be able to apply for Naturalisation. Could somebody point me the document which has this statement?

I have checked Naturalisation form and guidance but did not see this statement (I might have missed).

Page 5 paragraph 2 of Guide AN:
Unless you are married to or the civil partner of a British citizen, you should have been free from immigration time restrictions during the last 12 months of this period.
bear in mind the following further down the paragraph:
If you are married to or the civil partner of a British citizen you only need to be free from immigration restrictions on the day you apply.

Another Question: When to apply for Naturalisation? Is it exactly 12 months and 1 day after you have got the ILR or is it before 28 days of the 12 months ILR qualifying period?

The question is not the correct one to ask, so the answer might be one, both or neither! Depending upon the facts!

The relevant test here is the "the applicant was physically in the UK exactly 5 years before BIA receive the Naturalisation application" test. So check the dates in the UK very carefully. BIA have no discretion about this particular test.

Thanks John. I was in the UK from May 1st 2002. I got my ILR on June 12th 2007. So when should the application be made through NCS?

June 13th, 2008.

IF you were physically in the UK,Channel Islands or Isle of Man on June 13th, 2003.
