ILR 10 Yrs Urgent Advice Needed

ILR 10 Yrs Urgent Advice Needed

HI Guys,#

i have Tier1 HIghly skilled visa which is expiring in April 2015.
i came to uk DEC2004.

Q1) In 2008 i was granted 2 yrs post study work visa, would these 2 years are considered in 10 years long term settlement time period? i heard some exclusion terms of that visa in connection to settlement is that true?

i wana apply ILR after 1 week as my 10 years continuous period is completing on 6dec 2014(*but i heard i can apply 28 days before)

Q2) can i apply on the basis of 10 years completion or do i have to wait untill april 2015 when my visa expires?is there any restriction of who can apply? currently i am working less paid job and i am afraid i will have to struggle to reach 35k target.i think
i should apply under 10yrs basis and not on Tier1 extension basis. Any Thoughts?

You can use any legal visa status to apply for ILR 10 years residence, so PSW would count.

You can apply 28 days before reaching 10 years residence.

You can apply when you meet the 1 years, so December would be correct if that is when you arrived 10 years before.

Tier 1 PSW only counts towards long term residency. It does/ did not lead to any other sort of settlement...

You can apply for 10 years it looks like, provided you don't exceed the absence requirement and have proof of your 10 years of legal long residence (ie old passports with entry stamps etc...). You can apply 28 days before you meet 10 years.
