HI All,

I have an EEA2 resident permit but I am going through a divorce. My company is ready to sponsor a visa for me. Is the process of changing the visa type relatively simple or do I have to go to India and process it.

Any answers would be much appreciated.

You may have to go to India to switch if you decide to pursue this course.

Is there any way I can remain in the UK while I apply for my visa based on my company sponsoring me ?

You are better of sticking on the EEA, and seeking legal advise.

If you want to switch, you will need to leave the UK.

I can't stick to the EEA2 anymore as my marriage is going to end very soon. My company is happy to sponsor me and is willing to give me the letters required to allow me to stay in the UK. But i wonder if they would stick to that decision if I have to do this from India. Any clues how long and easy it is to do it from India ?

Have you filled in the divorce? Has it been granted?

You will need to apply from overseas.


I cannot advice you on the chances of success, whether the visa they are seeking to sponsor you on, require them to fulfill the local labor market test. How much points you need to get, and whether you will be able to obtain those points.

It will be stupid to give you such advise in a dogmatic manner.

No the divorce hasn't been filled or granted. But we are going to start the process this week.

So both of you are not prepared to wait i guess?

Then in that case, you will need to leave the UK to get an Entry Clearance as an Employed.

Please not that Settlement for some of the EC category are to be abolished.

Thank you for your prompt reply. If I do decide to go back to India and apply for my sponsorship through my company do I have get the divorce first. What happens to my EEA2 visa which is technically valid until 19/02/2019
