In all likelihood, it is when you are applying. However, the 35k is set to increase (and it is laid out that this will happen) over subsequent years. It has not yet come into effect. I agree it is not very clear, but with a max of 6 years for T2, I cannot imagine this rule applies for the entire period (what with having a new entrant salary band and experienced salary band and all). I am happy to be proven wrong.mahisrivathsa wrote:Hi,
I came to UK May 2013 on Tier 2 General (Employee sponsored) visa. That time my salary was £32000. Recently I got a pay hike and now my salary is £36000.
I read that there is a minimum salary requirement (£35000) for ILR applications after April 2016. Can someone help me if this requirement is through out the 5 years period or is it only after April 2016 ? The UKBA site has not have clear information in this regard.
Thanks in advance for your time,
Srivathsa
In addition, Tier 2 General and Sportsperson
migrants who apply for settlement from 6 April
2016 will need to demonstrate that they are being
paid a minimum rate for the occupation specified
on their Certificate of Sponsorship. The minimum
pay requirement will be either £35,000 per annum
(gross) or the appropriate rate for the occupation
as specified in the Codes of Practice published
by UK Border Agency, whichever is higher.
