Applied for an extension (Limited Leave to Remain as a student) and got another visa Valid from 20/02/2008 to 30/11/2010. In time application.
Applied for post study work visa (Tier 1) visa valid from 10/01/2011 to 10/01/2013.In time application.
Applied for EEA Family permit visa valid from 30/04/2012 to 30/04/2017.
Ive lived in the Uk now for 10 years and 2months. But now I want to apply for indefinite leave based on my 10 years leaving here legally but I ve a valid EEA Family Permit which is going to expire in 2017.
My question is if I apply for 10 years Long residence now, will my EEA family permit be cancelled or revoked because I still have about 3 years left on it. (My EEA wife is currently and has been exercising her treaty right).
Your urgent advice will be appreciated.
Unfortunately HO is not disclosing no. of august applications but it would be more than 700 at least so it will take almost 2 months to decide, taking into account of Xmas break as well. Similar question was asked in a TV law programme and they solicitor advised that EEA family permit is not a straight 5 years visa but it is given with a view to stay with your EEA partner and she will exercise her treaty right. Your treaty right started building up since you get married with your EEA partner regardless of the visa. Also, they might ask you about the evidence of treaty right whilst reviewing your 10 year ILR application. It is because HO is very cautious now a days specially for EEA marriages and they have a right to check whether it was genuine marriage or just for convenience to get residency.fielddrive wrote:If I was you @fabby, I'd get my ILR. I think it is too early to judge/approximate the rate at which August application will be decided. Its the 5th today and it takes approximately 2-3 days for the decision to reach the applicants. Not yet. Hello, I read on this link that the number of applications received in March 2014 was 6,205. They did put ILR (Perm Res) so I'm not sure if they counted only ILR or Permanent Residence applications from other routes.Arsal385 wrote:Do you have any official August 2013 figures for number application received ?

Yes sorry I posted that in a hurry. Thank you for your timeline.First and foremost you need to meet the financial (£18,600) and english requirements for your wife. The financial requirements includes 6-months bank statements and 6-months payslips. You wife must pass the english exam. Since your wife does not live in the UK at the moment am afraid she cannot use form FLRM, but i think she can use form VAF4A and please fill out Appendix-2 as directed in the application form. You should complete Appendix 2 if you wish to come to the UK as:
• The spouse or civil partner of someone settled in the UK; or
• The child of a parent who is applying for entry clearance as a partner or the child who is applying to join their parent who is already in the UK and has been granted limited leave as partner granted under the Immigration Rules in force on 09 July 2012; or
• The fiancé(e) or proposed civil partner of someone settled in the UK; or
• The unmarried or same sex partner of someone settled in the UK; or
• The Post Flight family member (spouse or civil partner, unmarried or same-sex partner, fiancé(e) or proposed civil partner, or child) of someone with limited leave to enter or remain in the UK as a refugee or is the beneficiary of humanitarian protection.

Just to let you know that your EEA family permit will be null once you apply for ILR on 10 years basis when it's approved by HO but it will remain valid during the processing time of your ILR.
Not sure but if your 2 children were born in the UK then you can get them registered as a British National since your husband already acquired his ILR last year.lsagar30 wrote:Hi,
