Child benefit for kids born abroad.

Hi Team,

Hope you are all well.
i am currently on ILR ( long residence) and 2kids on dependent Visa tier 1 (born abroad). There visa clearly states that they have no recourse to public fund.

What i am Not sure of is if I can apply for child benefit (only) - being the father who has ILR ?
Is child benefit based on parents/father/mother visa status ? yes or no
Also does that effect further extension of visa before permanent settlement for them.

Children don't/can't claim child benefit. It is the parent who is eligible that claims, so if you have ILR and you qualify, you can claim.

That is correct.

Remember to claim child benefit in your name and if you are going claim tax credits, these must be claimed jointly with your partner.

Thanks CR001,

Not sure if i am eligible for tax credits due to the reason that my salary is around 28-29 k some times more also wife is still under immigration control.
(no recourse to public fund).

I will need to apply for my naturalisation/passport in future - hope that does not affect that ?

Claiming joint tax credits, IF you qualify, won't affect your wife's future visa applications.

Claiming benefits that you are entitled to WON'T affect your citizenship application.

Afternoon CR001,

Thanks very much. I was about to apply for child benefit and child tax credit but a friend advised to double check coz my kids visa status says (under immigration control) . I believe it doesnt have any impact on their future visa extensions as well.
Apologies you have answered regarding my wife that her applications for visa wont be effected but I forgot to ask about the kids.

It will not affect their visas as the children are not the ones applying for benefits.

Again, if you qualify, you can apply for what you are entitled to.

Hope you are all well .

As you know that my kids/wife are under immigration control / I have ILR and I requested some information regarding child benefit and child tax credit which you kindly provided. If possible can you direct me to immigration rules/source of information which explains that People with ILR can claim child benefit /child tax credit even though there family is/are subject to immigration control.

I have a question regarding child benefits too,
I have got ILR a couple of weeks ago, and need to register my children on MN1 form as they were born in the UK.
My query is if I am eligible to apply child benefit before I get them registered, or do I need to wait until they are registered on MN1 form.
