Tier 4 8 year cap... help!

Hello,
I need some info. On tier 4 visa 8 years cap
my case is as follows

I did 1 year MS from UK 2010-2011.
Then I got admission in a PhD 4 year program so I extended my tier 4 visa for more 4 years.
but after 1.5 years of starting phd I terminated my studies and left UK and received an email from visa officer that my tier 4 visa has been curtailed.
now I got a phd offer from uni. In uk stating program duration 36 months /3 years

My question is that am I eligible to extend my tier 4 visa this time or home office will reject my application cause of 8 year cap?

PhD has no cap. See:exception.
If you had left the country within the deadline and now can meet all the necessary tier 4 visa requirements then most possibly can get the visa. However, you maybe asked again about the reasons which prevented you from studying during the visa process or at airport desk.

I didn't overstay I left well before I received the email of visa curtailment.

I have an other question when does the 8 year limit kicks in?
