Please help with EEA3 form

Post by Saladin0011 » Fri Nov 21, 2014 11:41 pm

Hello good people.
I am filling up my EEA3 application and I would like to ask for advice.
What to tick in section 7.1 when I was working in UK (in this case i know EMPLOYMENT) but i spent almost 1 year in my country studying Secondary school.

Should i tick Study or Unemployed and undertaking vocational training?

Should i use section 7.2 and write about my study?

another question is for 8.2
when counting days out of UK, should i count day when i departure but not count arrival day or not count departure but count arrival or none of them. In for is written:
When counting the number of days absent do not include the day of departure or the day of return.
This is a bit confusing for me.

Thank you for your advices.

Hello.

I understood your query for 7.1 as you being away for one year during the five year period. Is that correct? If that's the case, then you won't be eligible to apply under that the EEA3 route as you would have spent more than six months away from the UK. Such is my understanding but I am happy to be corrected.

For 8.2, you are required to only count whole (i.e. full) days away from the UK. So, if you travelled on 8 November and came back on 10 November, only one day counts (i.e. 9 November).

To clarify, are you applying for permanent residence?

All the best.

Thank you for answer.
Yes, this is for residency.
I red that there is exemption for longer absence such as pregnancy, army, study...
I was out for 8 months (probably a bit less) and I have translated confirmation from school and diploma.

I want ask moderators and gurus if is possible to do sticky topic with guiding how to fill up all that application forms for future easer answering of all this questions

Yes you are correct.

If it is for secondary school, the closest would be 'Study'. Vocational training refers to actual training (e.g. carpentry, mechanics, electricals, etc).

All the best.

Awesome. Thank you.

Just to make sure we understand to each other.
This section Study is for when i was abroad and not in UK too?

When ticking option Employment: from is clear, but To? what if I am here already 5 years+ and still working? Do I have to write date 5 years from start (let say 1.1.2009 to 2.1.2014) or leave it blank?

You are not required to exercise treaty rights while abroad. So there is no need to fill in section 7.3. You do need to use study as the reason for the long absence in section 8.

OK. So only employment but what about time From To?
Should I just chose some dates to make 5 years? I mean I am here over 5 years so I can pick any within that time? Or from day I started fork and To leave blank?

One more question.
Do I have to fill section 7.2 and 7.3 when I am only person applying for PR? Or leave it blank?
How I wrote I was in UK over 5 years but I spent about 8 months during this time in my country studying Secondary School.
Should I do only 7.1 and then 8.1 and 8.2?

Thank you and I hope this will be my last question in this case

8.3 addresses the absence of 8 months.

You should fill 7.1, 7.3, 8.1, 8.2, 8.3.

I was (am) confused in 7.3 with:
If your EEA national family member exercised Treaty rights
That is why I am asking if I have to fill this section, but if you guys say so I will do it.
