Long Residency dependent advice needed please

Post by imi2k » Tue Nov 25, 2014 10:05 am

Hello there!
I just want to share a bit of situation here that confused me lot and I need your expert advice please.
I have recently got my ILR on the basis of 10 years; I am living with my 4 dependents i.e. my wife & 3 children.
My wife & my daughter (was only 2 years old) become my dependent and joined me in UK back July 2007.
My 2 children born in UK and my family is with me from the last over 7 years now.
Now I understand that I straight apply naturalization for my children who born in UK,
However I am very confused that how to apply for my wife & daughter as some people say that I have to apply under new rules and I have to show over £22000 for six month statement, others says that as your spouse arrived UK before 2012 rules so you straight apply for 2 years or indefinite.

My question here:-

1. which rules should I follow to apply for my spouse visa?
2. My daughter who moved to UK when she was 2 is 9 year old now how do I apply for her visa too?
3. Last question if I am short of finance can I apply for them later stage as they have previous dependent visa that runs out July 2016?
4. please guide me towards these quires if also send me a link where I can do my little research.

Regards
Imran Khan

1. Unfortunately, FLR(M) (5-year route, Appendix FM-SE, Guidance).
2. Include daughter with mother's FLR(M).
3. Yes, if not travelling.

Dear Experts,

I am looking for advice on choosing to make the right application for my wife.

I have recently been (two months ago) granted ILR under 10 years route.

At the time of my application for ILR, I held Tier 1 General (extended for three years in June 2012 for me and my wife), but my ten years in the UK completed in June 2014 so I had applied for ILR under 10 years category and was approved in October this year.

My wife who joined me in the UK after our marriage on 18 July 2011, currently holds a Tier 1 dependent status, which will run out in July 2015.

She has passed life in the UK test and English at B1.

I am not sure what options do I have at the moment, as recent changes in immigration rules have created too much ambiguity.

Could you therefore advise me with best possible option?

I do thank you for your time.

K

Thanks Vinny,

Can you please confirm if my wife's time as Tier 1 dependent in the UK will count towards 5 years settlement?

Or her 5 years will start from the date of FL (M) approval?

Thanks

Or her 5 years will start from the date of FL (M) approval?
Her Tier 1 dependent years would only count for 10 years long residence application. She will have to start her 5 years qualifying again when she switches to FLR(M).

Thanks alot.

Its a very cunning and hypocritical change on the part of HO.

Lastly, will I have be ? to satisfy £18600 requirement, if I am using 6 months salary slips on part time (£700 x 6 Months = 4200) and dividend of £5000? projecting total income of £186000 from the company accounts for the whole year?

or I will strictly have to show £1550 x 6 months ?

Thanks in advance.

Hi Vinny/All,

Quick clarification...

So even if the wife and kid have been here for a long time their clock will be reset to zero and now have to start their 5yr for ILR??
Is this because of ILR Long resident of main applicant
or
Visa type/issue date of dependants...

Thanks

Thanks
