2 Questions on ILR

Hi,

I am on tier 1 visa which has the first date of issue as 19 Apr'10. However the application date was 01 Apr'10. What is the earliest date I can apply for an ILR? Does visa extension date has any relevance to the ILR (extension valid until Apr'16).

Secondly, since my wife only came to the UK last yr (thus falling into 5 yr stay rule before ILR) would it cause any trouble or issues if i am the only one applying for ILR (her visa is valid until Apr 2016)?

provide what is ur initial visa start date and when entered to UK first time. and what is ur current visa validity end date ? [these inputs for ur ILR eligibility]

Once you get ILR, your wife can still stay with the current visa. But after that she will be eligible to apply pbs dependent or FLR (m) both. As per my knowledge, If she applied as FLR (m), here eligibility for ILR start date will reset. So she need to wait another 5 years to get ILR. But if she continue as PBS dependent then, she will get ILR in 2018.

My application was in-country (means already in UK when applied initially), initial visa start date was 19 Apr'10. Current visa ends in Apr'16.

You can for ILR on or after 22nd March 2015 i.e 4 years 11 months 2 days from 19 Apr'10
