Tier 2 ICT Short Term to Long Term

Hi Gurus,

Need urgent help for my friend who is looking to convert Short Term to Long Term.

He was given Tier 2 ICT Short Term entry clearance on Aug 20,2014 and he traveled on 1 sept,2014 and left the country 30th Sept.
His expiry is on 30 Jan 2015 and he spent only 30 days in UK.

1. can he apply for Tier 2 ICT Long Term now ? ( he satisfies salary threshold )
or
2. he can apply for Tier 2 ICT Short Term exten before his expiry on Jan 30 2015 ( insider UK or ourtide UK) wherever he is?

3. Does cooling period apply to him?

The cool off period does not apply if he applies for ICT LT visa with a previous ICT ST visa.

To add, he cannot apply for a ICT ST extension without the cooling off period.
