Hi,
I am in a condition where the wait is not only affecting me but my 3 month son and a wife who is having medical conditions.
I came to Uk 4 years back as a student where after my expiration of Visa put in flro for temporary leave to extend and then followed by one refusal and another flro which was asking time to stay.
I got married and filled an application for flro. Which was refused: my wife was pregnant and was not considered as i did not had a child and my ties to my countries were strong as said . My wife was asked to leave with me despite being british and having a baby in womb we were asked to file in flrfp which was submitted late after 3 days time (solicitorz delay) as it was written my case will be rejected if not submitted on time, and response for rejection came within 4 days. We gave a pre-action protocol letter which had a acknowledgement but never came a reply sending my wife /baby not well being letters my whole scenario. (No circumstances of my ties and not being well were mentioned in my application which got refused.)

I filed a flrfp again now mentioning circumstances
We got married without our family involvement and consent where they have set so many instances where police got involved within Uk having threats which have been reported on either parties of which i have evidence and have been reported on several instances ongoing till now.
I have a 3 month old baby now
My wife have medical conditions having stress of my status,
Family stress factors where we are the only support of each other. Followed my wifez mri scanning and my babyz heart murmur in baby issue which is under dianosis. My wife is still under medication.
I and my wife do not have any ties with either two families as they are unwilling to accept me my wife and ultimately my child for running away and getting married.
I cannot work so survival is more than word "hard" where i have a small child and a wife who struggle everyday.
We have not claimed any benefits. My wife have managed to get back to a job which is our survival.
Under such circumstances our file is still pending and been almost 1.1/2 months of wait.

I have a very young baby, a wife who is struggling and asking to get refuge for me and her baby thinking we will be persecuted if we three are thrown out of the country. She has not commited a crime marrying me nor has my baby who is too young to face hardships. Its the wait which is killing us everyday.

In our scenario,
Please let us know our chance of survival
In case our application gets refused what we foresee

There is reasonable prospect of success. In fact i will go as far as saying that there is very high prospect of success, unless there are criminal convictions in play.

Your wife should claim benefits for herself and your child, as this will reduce the difficulties on the family in the meantime.

Claiming benefits will not affect your application, as you are relying on Exception 1, and financial requirement does not have to be met.

Do u think we should avail child tax credit to support our survival?
Normally how much time frame i should expect for my application reply?

No one can realistically tell you how long it would take for your application to be processed, that is nearly impossible. I do not think that if your partner claims whatever she is legally allowed to claim that it would affect your application. She/he should claim it in his/her name only but if there is a section in the form that requires his/her partner's details, that must be completed but make it clear that the partner is not allowed to claim as his/her immigration status is still outstanding.

Tax credits should always be claimed in joint names.

I am more than happy to share after such a long painful wait got my reply on 25th me and my wife were in tears when we heard that our case was considered. We appreciate the cooperation of our solicitor who did not even bother about their fees which we were unable to give to to our circumstances.

Claiming Tax credit and working Tax

There is a question in my scaring me as I received my BRP after too much wait and difficulty. We changed city and being on our own in a new place my wife applied for Child Tax credit and working Tax. We also receive child benefit.
my extension is due next year mid June.
Was thinking if the said is going to impact my extension?
But the tax credit and working tax helps us run our house.
My work recetly started working as was difficult with a 1.5 year old child.
please advice.

Hello all members,
My extention is due next year. My case was acknowledged after lot of pain and wait. This is my first extension. When we applied my wife was not working so we claim child tax in hername working tax and child tax credit in joint names. Of which working tax comes to my account and child benefot and tax credit comes to my wifez. Im a bit confused as my wife recently got a job and we both are trying to run our house as we have an infant of 1.5 years to look after. Our earning even together do not reach more than 16-18k a year. Please advice if any issues may arise at the point of my extention due next year. If so please let us know.
