180 days out of country in one stretch & ILR Please advice.

Hello everyone,

I have a confusion regarding 180 days. I was granted Tier 1 G in 2011 in country application. I went back home the same year for 85 days in one stretch. I got my extension for 3 years in 2013 and i went back home for 115 days in one stretch. only two visits out of country to visit my family these were not work related. my ILR is due in 2016, someone told me that i will have to take another extension as you can not stay out of country for more than 90 days in one stretch. But as far as i know you can spend 180 days in one stretch. Please clarify. Do i need another extension or i am ok to apply ilr in 2016? i will highly appreciate. thanks

Incorrect.

Counting backwards form your ILR application date, you should not be out of country for more than 180days/12 months.

So i am ok to go for ILR in 2016? I have two trips one for 85 days and other for 115 days.

Tier 1 General Visa granted: 2011 in UK

first holidays back home: 2011 for 85 days in a single trip after visa granted

got extension in: 2013

Second holidays: 2014 for 115 in a single trip

none of the holidays were work related these were all family visits.
Do i need to get second extension? i am bit worried as after 5 months i wont be able to extend my stay. Please let me know if i am fine with my holidays and can apply ILR without extension applying. thanks

Why don't you try calling ukba or emailing them about this query,cause I m sailing in the same boat.till date no body gave me the right answer for my 150 days absences (when I went to my home country)and was unemployed.
I myself m so confused abt this,I mailed ukba ,but no reply.

I dont think UKVI will change the 180 days in 12 months thing now , as its been there for nearly 2 years now.

They made it simple from 180 days in 5 years to 180 days in 12 months.

It is a grey area so guidance does not help much. in my opinion.
