Switching from family member to stay with Settled person

Hi,

I am currently on Tier 2 General visa which expires on 11 Nov 2015 but on 28th October my 5 years ends and theoretically I can apply for my ILR from 1st of October.

Mrs is on PSW at the moment and her visa ends in July so as far as I understood for this 2-3 months gap she needs to apply for a dependant visa and because she is already inside UK so she can apply under “Dependants applying in the UK on their own” section and after I get my ILR then she needs to apply for a “Remain in the UK with family” visa.

The question is, when I apply for my ILR she is still dependent on my Tier 2 visa so she needs to switch in to “Remain in the UK with Family” after I got it, is that correct ? if its correct how long she has time to do it after I get my ILR?

She should switch to PBS dependant as soon as possible.

After you are granted ILR, she may continue to apply for leave as a PBS dependant until she qualifies for ILR.
