hi Manchi,

I have been UK in March 2010 on Tier 2 ICT visa and recently shifted to Tier 2 General visa with new employer for next 3 years.


As i am completing my 5 years by Jan 2014(my visa was actually stampped in FEB 2010), i am applying for ILR. My spouse also been to UK within the same time. every time her visa got extended along with me WITHIN UK so far.

She had been to India from June 2012 to June 2013 for conceiving. She is back to UK in JUne 2013 and staying with me till day without any absence from UK so far. Since she is just completed1.5 yr continuously(total duration she stayed is around3.5 years excluding an year holiday) is she eligible for ILR in January 2015 or should we need to wait till July 2015 to complete 2 years!!!


Also, suggest me whether she can retain on Tier 2 Dependent till JUly if I take ILR in January 2015 or she has to shift to ILR dependent subjected to your response on above query!!

I got my ILR in April,2013 on long residency.
My wife is living with me in the UK since 2009 as a work permit dependent and student dependent recently till 2013. I applied for her extention under FLR M and she got her visa a month ago under two years route to settlement.

My question is can she apply for ILR now? Will her previous time be counted towards qualifying time for settlement?
She was out of the UK from April,2012 to Feb,2013.
