ILE and ILR

Post by Eamon » Fri Sep 07, 2007 7:07 am

My Chinese wife received her Indefinite Leave to Enter visa 2 years ago. She used it to enter UK and was assured that as soon as she did so it became Indefinite Leave to Remain, provided she entered UK before it 'expired' in July 2007, which she did. Before it expired she also left UK for a two-month holiday to China, where she now is. If it is now equivalent to an ILR visa, can she still use it to return to UK, considering that it may appear to Chinese (or British) immigration officials that the visa has expired?

Thanks in advance for any useful info.

When she first entered the UK, she should have received a stamp with the date that she entered. That would show that she entered the country before the expiry of the ILE, so I would think she should be ok. With ILE/ILR, you can pretty much come and go as you please, as long as you are not out of the country for more than two years.
