ILR LR Refusal

one of my friends got refused today
applied 26/8/14
he came to uk in 2004 on the student visa, applied for entrepreneur visa from psw in april 2013 and was refused.went to appeal and upper tribunal dismissed the appeal in june 2014. applied for entrepreneur visa again in july 2014 and got it in august 2014. applied for ILR LR in august2014 but they refused today saying that he had a gap from april 2013 to august 2014.they didnot consider the time spent in the appeal process

please advise.

The gap was only from when the appeal was finally dismissed. If he sucessfuly applied for entrepreneur leave within 28 days of the appeal's dismissal, then he should have succeeded with SET(LR).

he applied for tier 1 entrepreneur within 28 days of the dismissal of the appeal and subsequently got it. later on after completing ten years, he applied for the ILR. I think the case worker has just over looked it . what are his options as he still has the valid tier 1 leave till august 2017 ? any similar case?
