ILR (10 years) 33 Days Sort

Post by rg_nr001 » Fri Jan 02, 2015 1:10 pm

Hi Dear,
I came in the UK 18th July 2005 which I got on 07/06/05 till 31/08/2008 as student.

Then my first extension was from 11th July 2008 till 31/05/2011 as student for my graduation.

In February 2011 (2nd extension) I applied for T1 Post Study Work which I got it from 18th March 2011 to 18th march 2013.

My (3rd extension) is on T4 visa is from 26th April 2013 to 18th November 2014 (I applied on 4th March 2013)

My (4th extension) is on T4 visa is from 1st December 2014 to 15th June 2014. (I applied on 15th October 2014)

I am short of 6 days for the qualifying period which is 28 days prior to application and that makes total of 33 Days altogether.
Please advise what are my options... ?

Urgent Advise needed. ILR (10 years) 33 Days Sort

Post by rg_nr001 » Fri Jan 23, 2015 7:50 pm

Hi Dear,
I came in the UK 18th July 2005 which I got on 07/06/05 till 31/08/2008 as student. I am single person, No depended or children.

1) Now some people advising me that I should send my ILR (LT) application before my current leave expire on 15th June. As home will take time to process my application, I should be fine for the 6days sort. I should be qualified for date of decision.
Against Option 1, I have supplementary questions. As per Home Office guidance it says that if you apply 28 days before, your application will be invalid and you can reapply again. Also in the guidance there is this. “This is not a mandatory requirement of paragraph 34 of the Immigration Rules and you must not reject an application as invalid if the applicant submits it more than 28 days before they have completed the relevant qualifying period. For more information on applications for indefinite leave that have been submitted early, see related link: Early ILR applications.”
2) I should apply for an extension before my current leave expires on 15th June and vary my application.
Against Option 2, I have supplementary questions.
a) Under which Visa category shall I apply? As I don’t like to spend too much money for PhD admission or some things like that.
b) Many people telling me to apply for FLR (O) or FLR private life. What is the deference between these two categories.
c) If my current leave expires on 15th June, when shall I apply for next extension and after how many days I should vary the application?
d) If I vary my application, am I still will be ok as there are some conditions under section 3C or section 3D?

Please advise.........
