Two year route for PR

Hi there.... My name is jasmin... I have brought my husband over to uk under the spouse visa. We applied for the visa before the law of the 5 yrs come. But the refused it for some reasons.. They refused it before the 5 yr law. But when I went for an appeal the 5 yr law was brought forward... I wanted to know if I am still under the five yr route or two year route... When I went for the appeal they didn't ask me any information based on the five year route.. My husband was granted the visa in KSA and the biometric was for 2 and 3/4 year... Some of my friends husbands got the same visa but their biometric says two year and may be one or two months more.. I am really confused... Please help...

Was your appeal allowed under the Immigration rules or under Article 8?

But tell us on which ground your appeal was allowed. Was it allowed on immigration rules or human rights?

When was the visa given to your hubby and when is it going to expire? I'm asking because it might be a little bit difficult to argue this if he's got it for almost 2 years or thereabouts.
Hope experienced member or moderator can add to this?

My husband's visa was given to him december 2012. And it expires on sept 2015...

Do you have a copy of the appeal determination? It should give the basis of how the appeal was allowed.

No he's asking you for the letter you got after your appeal that your appeal is successful.

If the refusal was under 281, and the appeal was allowed under 281 as the transitional provision provides, then they were wrong to have issued your spouse with a 33 months visa, it out to have been a 27 months visa, which will enable him to apply for settlement 24 months after entry.

You should raise this with them, but the first thing, as stated correctly to you, is to establish on what basis the appeal was allowed.

Unfortunatly i haven't got a copy.. He applied for the visa in saudi arabia.. They called him and asked to take his passport with him when he go... Then they granted the visa... They didn't giva a letter..

I will ring the lawyer who helped me with this appeal.. I will ask him if he knows about it.. Its night time here now.. So will ring him to,orrow and let you know... Thanks for replying guys...

Hi all... Thnx alot for trying to help me.., good news !! My husband got the visa yesterday... There was no problems at all.. They didnt say anything... Sooo happy.. And once again thnx alot for willing to help... :)
