I'm holding a Tier 4 dependent visa, expires on 9th Jan 2015. I'm now applying a Tier 2 General visa.

My employer has done the labour market test for me (advertised on 2nd Dec 2014, for more than 28 days), then submitted the application of restricted COS on 2nd Jan 2015. The allocation of COS will be on 12th Jan 2015 (the first working day after the 10th of each month).

QUESTION IS:

By the time of receiving the COS, my Tier 4 dependent visa has expired for 4 days. Am I still eligible to submit an application of Tier 2 General as a Tier 4 dependent?

Yes, you can apply for T2G within 28 days of the expiry date but I wouldn't recommend it as it might cause problems for subsequent visa applications, especially if you have intention to settle in the UK.

If I was in your place, I would send the Tier 2 application by post tomorrow itself (before the visa expires) along with a covering letter stating that I'll be providing the CoS reference No. shortly (make up an excuse). I believe the case worker will not touch the application until biometrics have been enrolled and then send the CoS as soon as possible.

Appreciate your clarification as the tier 2 policy guidelines and immigration rules (6a) is not covering this senario clearly. On the other hand, this scenario ia very clearly mentioned in "Guidance for Sponsors, version Nov 2014 - clause 23.12 (c) where it specifies Tier 4 dependents with annual salary higher than £153,500 are to apply for an "un-restricted CoS). Appreciate your reaponse on my highlighted query. Many thanks in advance.

My understanding is that the dependant of a T4 migrant switching to T2G whose salary will be £153.5k or more can be assigned an unrestricted CoS.
