Goodmorning forum members,i have a question bothering me and my sister.she has been illegal in the uk since 2008 but have irish kids 8 and 6 year olds.she was formerly dating an irish man but are no longer together again.she wants to regularize her papers by using form flr fp. Irish citizens are treated as settled from day one when they enter the Uk so is it possible to apply as parent of a settled child on flr fp.pls your response will be appreciate.please note the kids were born in galway but moved to uk with their dad and me.

How old were the kids when they enter UK ? and how old are they now?

@obie the first kid was over 5 years old. She has stayed 2 years on the uk now.but Irish citizens are treated as settled upon arrival in the uk.please advise if a flr fp application will be successful

I think your understanding of the law is wholly misconceived.

Even if you are correct on the Irish Citizen having PR on day one, it does not assist, as the rules make provision for children who have resided for 7 Years or British citizen.

British citizen cannot be equated to Irish Citizen .

If the kids has been residing here for 7 years then you may have a case.

I accept the rules provide for kids with settled status, but this will not assist, as kids with settlement status does not engage exception 1. The parent will need to meet all the conditions in the rules, which I am sure the person in your case will be able to fulfil

So obie do u advise flr fp not good.will a chen ruling application be gud then.

That will depend on the circumstances.

She will need to demonstrate sufficient resources and CSI for Chen.

She should seek legal advise.

With csi and a balance of 2000 pounds in account be fine.and is overseas account accepted as well
