Spouse Extension

Dear Forum Members,

I am after some help please.

I am on ILR, I need to get visa extension for my spouse who is currently on Tier 1 General Partner/Dependent visa.

She got the dependent visa while I was on Tier 1 in August 2012 from Pakistan.

My question in here is, what application form do we need to apply for her extension?

Please can some one shed some light on it.

If you got your ILR based on 10 years long residence, then she should switch to FLR(M).

If you got your ILR based on 5 years Tier 1 then she can continue to extend on the PBS Dependent form.

The settlement was on the basis of Tier 1 General.

Then she can continue to extend on Tier 1 dependent but the choice is hers if she wishes to switch to FLR(M)

Hi CR001,

I just wanted to confirm the following please,

If she apply using FLR(M) will it reset her 5 years clock?
If she apply using FLR(M) do we need to fulfil English Language requirements?
If she apply for extension Tier 1 dependent form, will she need English Langauge?

Both application forms have got massive difference in fees. Which one is best to apply with? I just want to understand the pros and cons for both.

I would really appreciate if you can answer above please.

When did your wife apply for the visa that was issued in August 2012?

Hi Obie

She applied under the rules which were in place after 9 July 2012.

The form for extension as Tier 1 Dependent does not mention English Language.
