Favour, bobby2000 thank you for your encouraging words. I too think this has a lot to do with the election... I worry about upper tribunal costs... How likely is it they will receive permission? I imagine quite likely :(

@Ems1927...there is another thread discussing appeals allowed. It might be helpful if you glance through. You may get answers to your questions.

Hi there

I am using this forum from a while. I found it extremely helpful. I have a situation, shouldn't be new to most of you guys.

I have got ILR last year. I have got 2 kids they are British nationals now. 5 and 3 years old. My Mrs came into this country 8-9 years back. But she does not have any status in this country. Now we decided to apply for her.

As she not been back to her country for long time. Can she go back and apply from there as i am earning more than £19000 per year.
Any suggestions in my case if she goes back , Merits & Demerits and any consequences which can effect on the applications. As my both kids just started school this year so i am looking to send her this summer to see her family and apply from there as well.Kids need to join back school in September again.
I believe if she will granted visa from back home . it would be 5 years instead of apply inside the UK discretionary basis 10 years route.
She stayed in this country illegally for such a long time , could this be a worst effect on the considerations for the application.

I will highly appreciate for your expert advice and experiences.

Best Regards

Does anyone have an idea of what could be the issue with my application that raises human right issue and what to expect. Have heard nothing since biometric done on 17th Dec,2014. Reason am worried because,My previous visa applications doesn't take this long. I can't start clinical attachment until I receive my visa and also got Valid 2 yrs U.S Visa on my passport. And with what am reading on here. Seems like an endless wait to get response and wouldn't want my U.S Visa to waste or loose my chances of clinical attachment. Any Idea anyone?. Thanks.

Hi... I made an application for leave to remain as a doctor taking clinical attachment on FLR O form (8H-other purposes) before the expiry of my current PLAB Visa (Dec 11, 2014). I received Biometric letter with ECHR letter stating that my case is complex and raises human rights issues and as such will take some time to process. Just wondering Why my application raises human rights issues ?.

My Visa History:
I have been living in the UK for over 5 years now as a student then student dependant prior to my going on PLAB Visa 6 months ago. Have never overstayed my visa and do not have any criminal record. Completed a DBS check 2 weeks ago and all clean.

PLAB visa is usually given 6 months at a time and extension is possible, maximum 18 months in total. I have just used the 1st 6 months and wasn't expecting any Human Rights stuff.

Application date: 9th December,2014.
Received: 10th December,2014.
Fee Deducted: 11th December,2014.
Biometric + ECHR Letter : 17th December, 2014. Dated 13th December,2014.
Biometric Done: 17th December,2014.
BRP: Waiting.

Does anyone have an idea Why my application raises Human Rights Issue and What I should expect ? Thanks.

Hi
I’ve been a silent reader for about a month now and I’ve decided to register today.
I’m British citizen and I’ve been with my partner for 2years now. We have a child together who was nearly 10 months when we applied for FLR FP and discretionary leave to remain. Though we don’t live together my partner is very much involved with my daughter. Do you think we have a case or not? Also how long does it take to get a decision?

Application submitted on 06-11-2014
Acknowledgment Recvd: 18-11-2014 dated 14-11-2014
Bi-metric Invite Letter: 18-11-2014
Biometric Submitted: 01-12-2014
Still waiting to hear from UKBA

Hi forum members,

I’ve been following this forum for the past few years, and I have to say, I have found it incredibly helpful.

We found out on Monday that we have been granted 30 months, and I felt obliged to thank everyone here for all their help. It was really good knowing the mindset of the good old UKBA whilst we were waiting

Here’s our story:
2003: Mum (40s), me (12), brother (8) came to the UK on holiday. We ended up overstaying for a number of reasons, including parents separation.
2005: Mum has my little brother (he has medical problems)
2010: First application based on little brother’s illness and family break up. I don’t know the full details, but I know there was a refusal, which was followed by appeals, judicial review, etc.
Late 2011: Mum puts fresh application with my 2 brothers. I was not included
Again, there was a refusal
2012: Reconsideration requested
We heard nothing for almost 3 years
August 2014: Brother now 19 applies for right to private life (18-25 route). Did biometrics, and then we heard nothing till late November
Late November 2014: Letter from Home Office requesting that mum, me, and little brother go for Biometrics
January 2015: All 4 of us are granted 30 months

I was granted under ‘18 to 25 and spent half of life in the UK route’ although I’ve technically not reached half life. I was a few months short, and I wasn’t even included in the application, so I am crazy surprised by this whole thing!

Anyway, God has once again shown me that he’s the greatest! Thank you Jesus!

I hope everyone gets the news they’re waiting for soon! :D

lm a 24 years of age with a British partner (not married) and a British child. l came to the Uk around the age of 9 with a family friend of my grandmother in 2000. few months after that she left. i lived with the woman's daughter (whom i called auntie) for 3 year looking after her children and attended primary sch; after the 3rd year her daughter decided to relocate to another country and asked me to live with her friend and since that day in 2003 l have never seen or heard of her, nor know where my passport i use to come in the country as the lady l used to live with had it. lived with the friend and was studying at the same time. i went to primary school (yr6) here up to sixth form college. couldn't go to Uni as l had only discovered my status when l was trying to apply for uni. l finished sixth form in 2009 and was really depressed when l found out l had no status and the auntie's kicked me out of her house in 2008 as she said she could no longer looked after me no more. then another lady that know her took me in. in the space of 2000 and 2010 l lived with 3- 4 different people. my sixth form tried to help along with the lady l was leaving with at the time but the solicitor l went to see at the time suggested that l waited 14 years (2014) and l can apply automatically (which l really did not understand at the time).

3rd April 2014 my solicitor submitted an flr (o) application on my behalf on the basis of my private life and article 8 right to family life with my child and partner.
with this application l submitted every single thing l had including letters from my school friends and my partners family and some photos, to prove l have being in the uk since l came. in September i was sent a letter for the Biometric on the 23sept the SSHD refused the application and no right to appeal.
solicitor wrote a reconder letter to the HO but there was no respond , the 'Capital' called me and emailed me that waht am l doing about the refuser as they will be watching me, calling me till l get depoted etc so l told the to call my solicitor.Although by this time my solicitor was not taking everything serious no more but then suggested we go for JUDICIAL REVIEW but l have to applied for the fund 1st (LAA) Filled the application as l am a full time mother, the legal aid agency claimed my partner earns more than the avery (only by £30) not having other bills he has to pay and only work part time. the LAA also refused to fund me. my partner at this time is in dept and can no longer paid for anything concerning my case any more and l dont work and the solicitor is telling me that the only thing l can do now is to go private with judicial review ( £1000-£300) which neither l or my partner has. the solicitor now only told me that the deadline the homeofice gave him is the 22nd DEC 2014 which he only told me about just on the 19th this month. l dont know what to do no more, i grew u with my grandma back home and she was sick, couldnt look after me thats why the lady that brought me here took me from her in the 1st place. i dont know if she is still alive or not as of when the lady brought me and her daughter left the uk i never heard of them. my only family is my son,my partner and my partner family which they all live here. l am just leaving everything in GOD'S HAND and pray that l found favoure. l am also thinking mayb to find a citizen bureau near by also. CAN ANYONE HELP ME PLEASE? ANY suggestion please. THANK YOU

Greetings to You and Happy new year.
Reading your post here I realise You are in a kind of similar situation as me. I believe you were not given right of appeal as an overstayer...In my case I had no right of appeal so my solicitor immediately requested a reconsideration of decision from H/O which they granted 3 years after request and I am still awaiting that outcome.
You may have to do whatever you can to raise funds and launch a fresh application as living in the immigration abyss is no fun at all as you know now... When that time comes please get back to this forum and get as much advice and insight as there's really a lot of it on here.
Good luck to you and Your Family.

Hi everyone.
Allow me to get straight to the point .Here is my timeline. My first discretionary visa was granted on 17/10/ 2009 it was for three years. I applied for an extension on time on 26/09/12 but due to home office delays had to wait for roughly 12 months (one year) to be granted another three year extension on 22/09/13. My current visa expires on 21/09/2016 at which time it will be seven years since I was granted my first discretionary visa.

My question is when do I apply for indefinite leave to remain and how do I factor in the delays from the home office. Should I apply when I reach six years since I was first granted my first visa or do I have to wait until this current visa is about to expire. I would appreciate it if those in the know could help me out.

Happy Year to you all
Congrats to those who have been granted
Yes Toa,am in the same situation as you are
Just today i have written to my MP to clarify things before applying for Indefinite,
I was granted my first discretionary in July 2009,i applied for extension in June 2012,granted in July 2013,it took Home Office 13 months to grant the extension,
I have asked (8)different lawyers, they all say the same thing, that i should apply for indefinite as soon as i clock 6 years from the date of the first grant,as long as my extension was intime application,i am covered with 3C Leave,of immigration acts 1971,
Once i receive comfirmation from the MP,i will update everyone
