Cooling off period for Tier 2 ICT to Tier 2 Gen

Hello

I held a tier 2 ICT visa from 10 May 2014 to 17 Sep 2014. I travelled to UK between 11 May to 5 July i.e. I left UK on 5 July 2014.

I have now found a job in UK with another company (in Jan 2014) and the employer is ready to sponsor a Tier 2 General (note this is another sponsor).

My question is whether I will have to wait till July 5, 2015 to apply for the tier 2 General visa because of 'cooling off' OR does the cooling off doesnt apply here?

If cooling off applies in my case, can the CoS process start right now (Jan 2014) with a job start date in Aug 2015 and the visa fees and application being made in July 2015?
