MN1 for my 16 yr old living in africa (born in africa)

Post by futty » Tue Jan 20, 2015 7:32 pm

Hi all

I hope you all well.

I'm in need of some advice please.

I am a BC acquired through Naturalisation. My 16 year old has been living in the UK for few years( she was born in Africa) ; however due to some serious reason , she has had to leave the country and now lives in Africa since Dec '14. She has an ILR since 2012 which will expire in 2017. I did not register her for BC while I was applying for mine. I am hoping that she returns to the UK when she is 18 or few months before she is 18.

I am now looking to register her. I have been in contact with the immigration firm which helped me with my ILR but they told me that :
1. she need to be in the UK to make the application for registration as BC.
2. she should not be out of the UK for over a long period ,otherwise her ILR will be invalid.

Can you please offer me some advise and I would highly appreciate.

Many thanks, and I will be happy to provide more information if required.

1. Yes.
2. Yes. Should return for the purpose of settlement within 2 years.

Does she also need to be in the UK for 2 yrs prior to the application ?

or

If I bring her back within 2 years then make application, that's would be fine.
