Domestic violence rules abolished?

Hi everyone.

I am posting this question on behalf of my friend who is non-EU and is married to EU national form last one year and has been granted RC few months ago. He is a victim of domestic violence from last few months, has got involved police about the incidents and been to his GP too many times. Is he eligible to apply retain of rights application on the basis of domestic violence ? some solicitors told him that Home office has abolished this rule and he cannot apply anymore.

Your answers will be appreciated.

what evidence has he got demonstrating he has been a victim of DV.

I don't know that whether domestic violence in EU directive give anything to non-eu national and the ror option is only available if divorce the EU national after three years. But if EU national is settled means have PR then maybe indefinite leave option become available depending on the severity of domestic violence. Read below:

Thanks for the reply Obie and universal soldier.

He has been taking CBT sessions with psychologist as it was referred by his GP due to anxiety and depression. Furthermore police attended his house and they gave his wife verbal warning. So far that's all evidence he has got.
