Hope this is the right forum, I read a few posts and this seems like the best place to get an experienced answer to some of my worries and questions.
Background:
Born in the UK 1985, left 1986 (1yr), was in and out of UK over the years as a visitor until oct 2000 (age 15) when i returned on a student visa. Over the years had a few late renewals on the visa (thus i didnt qualify for 10yrs long stay), in oct 2010 i had to renew my student visa but could not due to the new points based system needing a CAS number which i couldnt obtain till december as i was exempt from the modules in the 1st semester. I sent a FLR form (oct2010) more or less to waste time while this CAS number was readied and during that month got legal representatives to deal with the case. FLR rejected of crs wanting me to send the correct application, here the solicitor sent this (feb2011) after receiving the CAS number but it failed with no right of appeal because the solicitor had sent the wrong bank statements, paid and went through judicial review etc which over the months i was still at university and thus completed my degree. After which i was asked to submit a new application, but as i had finished uni the solicitor sorted out a work visa application (nov2011), this was rejected (july2012) on 2 grounds (1)i hadnt received my degree while in status, (2)the first reason meant they failed me on english language (this is even though i speak english, did my gcses and a-level here). Anyway so i was advised and decided to use this new solicitor to apply for FLR(o) private life (sept2012) this was refused (sep2013) on grounds that although i have ties here i can go back to my home country.
Since oct2010 i havent been given any status thus i guess im an overstayer, also since sept2013 i havent applied for anything.
In this time my girlfriend (british national met at uni) of 7years has moved in with me from march2014, im with a new lawyer now and this is how we want to handle it.
My gf and i hope to get married/registered within the next few months (if get a detained or not i dont know), during which i will send another FLR under private life article 8. apparently if i get detained and to be deported i will get a right of appeal which can be used to put my case forward.
My questions;
1)the marriage process i assume immigration officers will be guests there and we will be interviewed by them - what can i expect or any advise?
2) regarding the FLR what are the chances of success now given i was born here, have been here since oct2000, have ties here and maybe a marriage even when application is to be sent.
3) regarding supporting documents for relationship can anyone give me a full list as to what i should gather?
Any advice at all please share, thanks.
Thanks in advance.
