OCI for minor born in UK to Indian Parents

Is this child eligible to apply for OCI?

I have gone through the Indian High Commission websites and have conflicting information.

One of the FAQs on OCI clearly states that foreign born minor child whose parents are Indian Citizens is not eligible for OCI.

Yes, if either of the parents is eligible for OCI.  Minor children of parents where both (father and mother) are Indian nationals would not be eligible for OCI.

However, if you look at the following information on the website:

An applicant who is a foreign national by birth or who never possessed an Indian passport would be required to present the certificate issued in lieu of surrender of Indian passport of his/her parents/ grandparents on whose basis the applicant is claiming his/her Indian origin.

Such certificate however, would not be needed if the passport holder on whose basis application is being attempted continues to be an Indian citizen or is deceased

So this one says - for the child to apply for OCI, the parent need not have surrendered his passport (and become a foreign citizen) and can continue to be an Indian citizen for the child to apply for OCI.

Am confused now.

this is a very old thread, im in a similar situation. Me and my wife are on ILR and my daughter (1month) is having British Passport. So can I apply OCI for her?

In old route OCI was not possible yet, however PIO and OCI routes have been merged, hence your child can apply for OCI.
