Hi Friends,
Can someone experience persson highlights on this issue as I have the scenario aswell.

Thanks
Tahir

quote="Desi Pakora"]Dear Friends,

I need professional advise please.

My previous visa was granted on the basis of Tier 2 General and my wife was dependent of it i.e. Tier 2 general dependent visa. That visa was valid until March 2017.

I have now received my ILR on 10th January 2015 on the basis of 10 year route and therefore i need to change my wife dependent category through FLR(M) application.

I have following questions:

Is there any time limit in which i shall apply for my wife visa? keep in mind her previous visa is still valid until 2017.

Is 28 days rule apply on her i.e. she need to submit FLR (M) application within 28 days of my ILR?

She need to do English test, and she may get result in March. Is it a good idea to submit her application to home office now while stating on the cover letter that english language certificate will be provided later. This is just to keep us on the safe side of 28 days rule.

Please advise urgently .

thanks

It is advisable to apply for change of status the earliest possible. English test certificate could be attained on fast track basis in 4 days. You can also dial this number 03001232241 & option 4 for these type of questions directly from HO.

Is there any law for this that you have to apply within 28 days?

ILR should be fine, they dont consider ccj for ilr but might affect naturalisation application. But as you got payment plan you should be fine even then. I have seen some ppl got ilr with ccjs

Hi can anyone help to clear my confusion

I got my entry clearance on 15/12/2004
Aarrived in uk 23/12/2004
Been all time on student visa
Last leave finished on 30/10/2014.
I was short of about 1 month and 24 days
I did apply FLR (O) on 30/10/2014
Got acknowledgement 7/11/2014
Biometric 12/11/2014
2nd biometric 25/11/2014
On 3/12/2014 I did vary my application to Set LR
Got acknowledgement on 12/12/2014
Biometric on 18/12/2014
Biometric done 18/12/2014.

My question is that someone on the forum said that if u vary u application then u cannot exempt for 28 days u have to complete ur 10 years then vary ur application for set LR
I m really confused since that as I applied my set LR on 3/12/2014 while my 10 years completes on 23/12/2014.

I m really worried m I be ok or HO will refuse my application as of early submission like out of time application.

Is there any law that if ur current leave expires n u put an in time application cannot be varied until u complete ur 10 years means u cannot apply before 28 days ????
Plz qoute.
Thanks

@ DMH2014

It doest make any difference .. you applied for FLRO and varied your application and you completed your 10 years while your application was in process.........
