Urgent Help required

All,

I need quick information. I have ILR and did not apply for my family due to financial constraints. My wife underwent an operation in India in Jan which the surgeon messed up and caused internal damage. Due to that she needs to wait till march/april before she needs to get a major surgery to repair the internal damage. The issue I have is she is on tier 2 dependent visa which expires on April 2016. I was planning to apply for their ILR in sept 2015(as she was with me from 2013 sept and that gives 2 year period) but because of this there will be a gap from dec 11th to whenever she comes back. Will this affect her ILR application when I apply later in the year. What option do I have.
I'm in constant touch with her daily via whatsapp and phone and have all the necessary docs for her surgery. Please can anybody help me in this matter.

This is her status from 2010

UK : 13-Feb-2010 to 16-May-2010 for 13 weeks
India: 16-May-2010 to 10-Mar-2010 for 43 weeks
UK: 10-Mar-2011 to 09-Jan-2012 for 44 weeks
India: 09-Jan-2012 to 18-May-2012 for 19 Weeks
UK: 19-May-2012 to 01-Dec-2012 for 28 weeks
India: 01-Dec-2012 to 17-Sep-2012 for 41 weeks
UK: 17-Sep-2013 to 11-Dec-2014 for 64 weeks
India: 11-Dec-2014 to date

I was looking to apply based on Sep 2013 to Sep 2015 as a 2 year period but unfortunately due to her medical condition she had to travel to India and that is where the operation issue happened.

Hi Zaheer,

You cannot apply on 2 year period and the gaps seems to be in last 5 year is big.

You can apply on 5 year basis.

I will suggest you to call UKBA 0300 123 2241 and explain if you submit valid surgery douments, phone bills, chat details for the gaps for last 5 years does it gonna help?

I will call the number. I do have addresses for the last 5 years with her name and mine. I applied my ILR on 5 year basis. Are you able to confirm that it will be fine on 5 year basis.
