ILR and British Citizenship

Post by newbie_t » Fri Feb 06, 2015 8:58 pm

Hi all,

We got a situation and need some advise please..

My 2 kids and I are British citizens, but my wife isn't (she is on ILR and couldn't apply for naturalisation as she has stayed outside UK for more than 450 days in the last 5 years/ 270 days in last 3 years).

Now I got an opportunity to work abroad and would like to relocate with my family. I understand that her ILR will become invalid if she stays outside UK for more than 2 years, but if she visits UK often would it still be the case?

If the ILR becomes invalid, can she apply for 'returning resident' visa? I read few other threads/forums and doesn't seem to be straight forward? Has anyone here applied for 'returning resident' and share their experiences would be really helpful.

Thank you.

Best regards.

Here's official link to visa page.
Being British is a state of mind.

She has to enter UK within 2 years in order to keep her ILR.
How many days in total was your absent in last 5 and last 3 years?
Maybe she can apply for discretion.
I am sometimes wrong.
