Hi all,

I got my ILR on 10 year basis in January 2014 and ready for British Naturalization my question is bit complicated,

My Spouse Arrived in UK as under below

Student dependent : 8 august 2007 - 2.1 years and 22 days (non PBS )

Switch to PSW (Tier1) PBS dependent 1 year 11 months (does it count towards qualifying period for ILR ? ).

Switch to Tier1 (General) PBS dependent 2 years 11 months outside country because of illness informed HO in FLR(M) Application.

Switch to FLR M 1 year (old rule pre 9 July 2012) in January 2014

She has been here total of 7.5 years in different visa categories with 13 months leave out of country below.

(2 Months) 1st March 2010 to 30 April 2010

(11 Months) sickness leave from Jan 30 2012 to 17 December 2012

The question is, is she eligible to apply for ILR set (M) or (o) for basis above ? as she has been PBS dependent twice as PSW/Tier1 General or she has to complete 2 years of her FLR (M) (1 year is also completed) and then apply and also if she is eligible for ILR what will be British naturalization criteria after getting ILR, is it immediate because she is here for last 5 years or wait for a year to apply for BC ?

please help as ILR fee will increase in April 2015 to £1500 :(

Your advice will be highly appreciated.

Thank you for very unhelpful answer, but I hope you will be bit helpful next time for other forum members.

My question was rather information related to HO law (that is what I believe this forum is for) correct me if I am wrong.

I wish that people will not fail this forum with sarcastic reply.

If she is on FLR(M) then ILR is on SET(M). What date was her FLR(M) granted, the exact date??

Did her visa expired during this time out of the UK?

It might help if you stated visa start and expiry dates for each visa she has had and in bullet point format. Also bullet point of exact dates of all her absences. It makes it easier to understand than the way you have explained.

Thank you for your reply, here are the dates requested by you in 1st to last visa obtained, Please do let me know if you need further info.

Visa dates first to last

Visa No 1: Non PBS Valid from: 13/06/2007 - Valid until: 30/09/2009 - UK Arrival : 8 August 2007

Visa No 2 : PBS dependent (PSW) Valid from: 26/10/2009 - Valid until: 26/10/2011

Visa No 3: PBS dependent (Tier 1 General) Valid from: 25/09/2011 - Valid until: 25/09/2013

Visa No 4: FLR(M) Valid from: 28/01/2014 - Valid until: 28/01/2016

Note: All Visas (Visa 2/3/4) extended within UK after 1st stamp (non PBS)

Absences

1st : Absence: From: 01/03/2010 to 30/04/2010 <= Absence during Visa No 2 : PBS dependent (PSW)

2nd: Absence: From: 30/01/2012 to 17/12/2012 <= Absence during Visa No 3 : PBS dependent (Tier 1 General) ickness

What date exactly did you get your ILR via 10 years long residency?

I see no reason why she cannot apply for ILR on Set(M) as she switched to FLR(M) before the rule changed in April 2014 regarding PBS dependents of long residence applications. Even with her long absence in 2012, she has completed the required 2 years upto December 2014.

Perhaps one of the other moderators can confirm.
