10 years Long residency continuous period start date

10 years Long residency continuous period start date

Dear All,

Could anyone please shed some light on the following.

When does the continuous residency period start when applying based on Long term (10 years) residency? Is it
28 days before the Entry Clearance Date OR 28 days before when you actually entered in the UK ?
My Student Entry Clearance Visa was issued 30-April-2005 and I entered in the UK on 28-May-2005.

It starts from the date you ENTERED the UK, so in your case it is the 28th May 2005.

Provided you meet all the requirements, you can submit your applications no sooner than 28 days before 28th May 2015.

In some places like Page No. 22

It mentions - "The period between entry clearance being issued and the applicant entering the UK may be
counted toward the qualifying period,as long as it does not exceed 90 days."

Do you believe this is only for 5 Years ILR applicants and not for long term ILR applicants ?

The applicant must provide evidence, as above, for compelling or compassionate reasons
only.

That concession of 90 days in only applicable to ILR applications based on 5 years (PBS routes).
