Fiance Visa

Good morning

My Japanese fiance is just about to hand in the completed application to the British embassy in Tokyo but there were 3 outstanding queries that we had.

Q1. She has been living back in Japan since July after one year of study in the UK and her current student visa for the UK doesn't expire until the end of Sept '07 so does that mean she shouldn't hand in the new fiance visa application until the old one has finished?

Q2. In the application form there is a question about when you want the new visa to start. The visa gives us a 6 month opportunity to get married and we have booked a date for Feb'08. But does the visa start from the date on the application form or when she actually enters the UK?

Q3. Does anyone have any experience of the application process via the embassy in Tokyo re: how long the process takes and any other insights?

Using your own numbering to answer:-

1) If the student visa finishes in 2 weeks time what is the point in answering the question. But to answer your question, even if it was valid for longer, you can apply for the Fiance visa whilst the other visa is running.

2) The new visa can be post dated upto a maximum of 3 months. So, depending on when your fiancee will enter UK you can ask for the visa to be dated accordingly and even if you do not get it post-dated, it still is less than 6 months to Feb 2008 and should be alright.
