Tire 2 depend

Hi,

I am asking this question on my friend's behalf. Her husband is holding a Tire 2 visa and eligible to apply ILR this month. My friend is holding a Tire 2 depend visa, she came to the UK with her husband in Feb 2010. My friend went back to her home country in Dec 2011 due to a family reason and came back to the UK in Dec 2013. My question is that can my friend apply ILR with her husband together this month or she has to change to a spouse visa first and wait for another 5 years ro get a ILR?

Any answers will be much appreciated.
