In 2014 I arrived to study and the college was to vary my visitors visa. Which they tried and ukba advices to apply from home country .. Left the UK during half term for less than 28 days in which I Varied to student visa in India came back within 28 days . Got a letter from the college
I think it says continuous lawful stay . Said my supposed amazing lawyer
I withdraw my appeal .before I made application . Done on sameday
I dislike appeals they take a very long Time even when u win , they take forever to issue u a visa which might not be ilr .
So I decided to go for a fresh application .

Was wondering in ur case . Wat visa do u get .. Cause then I just wasted 1098 on the set lr fee ..

Well problem with ILR after withdrawing appeal is in case they refuse they we get no right to appeal
Plus no right to work once appeal is withdrawn
If God willing appeal allowed then ILR

It is really frustrating, the quality of information from the call centre is appalling. I rung home office today twice and spoke to two different people and both of them said that the home office is still looking at the Oct applications and they had the Monday update from home office. Either they don't tell us correct information or they don't have the correct information. Either way just horrific. On the other hand, this forum is a great tool. Please keep it running for others to come. I applied on Nov 8.

I will highly appreciate for your help and advice:
I am in very difficultly position.I was a student,living in UK with my wife and 2 year old son.My visa was refused on human right ground.My appeal's hearing in First Tier Tribunal was on June 2014. 5 month before the hearing date on last January 2014, I changed my solicitor and present solicitor informed Home Office and tribunal about the changes and he represent me in the hearing.I did not knew the decision until I phoned Tribunal on 2nd week of August 2014 ,they told me Tribunal dismissed my appeal on first week of July 2014 and I was also shocked when they said they sent determination letter to my previous solicitor's address.
After many correspondences with Tribunal,Tribunal re-issued decision letter on first week of December 2014.Then we sent permission to appeal for Upper tribunal to First Tier tribunal within 14 days.Middle of January 2015 I phoned First Tier tribunal to know about the outcome and they said they haven't received my permission to appeal for Upper tribunal.but my solicitor said he have proof,he have the receipt from fax machine that he sent the permission to appeal.now he is contracting with First Tier Tribunal.
First week of august 2015,I will qualify to apply ILR on 10 years ground.I am very much worried that Home Office could say I have the gap in continuous residency during appeal process.I needed to kill those time to qualify for 10 years route.does my solicitor intentionally doing this to spent those time,why he is not telling me then ? or those issues occur because of lack of his responsibility ? how can I over come from this situation ?
I will highly appreciate for your help and advice

My application has been approved. Received the decision today (17 Feb 2015) on a letter dated 15 February.
BRP card should be with me in couple of days.

Hi all,
I guess the case worker processes the applications on the basis of bio enrolled date rather than date of application individual made. the reason i am saying if you notice the timeline those application [incl. mine] are pending have delayed bio date [except Arsenal 1]. in fact, the the consistency is more on bio weeks rather waiting weeks. Besides, a lady from HO once mentioned that caseworker get the ILR files on the basis of bio date and although they consider 6 months limit on the basis of app date.

@effell007, you probably right!! how HO prioritize the ilr apps, is the biggest secret of 21st century . There is big variation among each application when you look at date of application and date of decision??

Based on the data for the past 3 months, they are taking approx 14-15 weeks from the Biometric enrolled date. There is typically higher volume around Sept-Oct. Typical waiting time (based on 2014 data) is c12 weeks after biometrics have been enrolled.

Hi Poirot,
there were huge number of applications made in august which affected more towards the end of august applicants on ward. now as it seems that back log has been cleared. so processing time is going down as well. lets hope for the best.
