UKPC Parking Fine

Post by Tier1Gen » Thu Feb 19, 2015 3:29 pm

Hi Members,
I was handed a parking fine by UKPC on private land, which I am contesting.

I have read in many places that these tickets dont have the legalities like PCN and FPN.

Just wanted to know if anyone here can confirm this.

I hope I would be fine if I dont mention this in my Naturalisation Application.

Regards,

I am no expert in fine etc but I am guessing you are contesting it in Civil Court?

If it is then according to AN guide on Page 9, you must give details:
3.8 – 3.9 You must give details of all civil judgments which have resulted in a court order being made against you as well as any civil penalties under the UK Immigration Acts. If you have been declared bankrupt at any time you should give details of the bankruptcy proceedings. (Your application is unlikely to succeed if you are an undischarged bankrupt).
Being British is a state of mind.

Hi fwd079,
Thanks for your reply.

I am at the moment planning to appeal to UKPC which will be sometime next month

And then will go to independent body POPLA.

Nothing to do with the courts at the moment.

If I were you, I would have binned the notices without opening them. Even though they use very intimidating language and format, there is very little they can do when it comes to getting the money out of you. They will try their best to make you pay by intimidation.

Basically when you use their parking space, you are agreeing to their terms and conditions(both parties' consent is required in order for it to mean something). In terms of legality, they need to know your details before you are bound to the conditions. They can get the register keeper's details by paying to DVLA but you could be driving anybody's car so they can't really prove who is responsible.

My brother had one, he just replied to them saying it was dark and he didn't see any notice and that was end of it. Even though it was at services on M6/M74 which are usually lit.

I second some of the things said here. They are absolutely useless. I had one from JAS not so long ago. As you mentioned, appeal to POPLA. They take about 2-3 months to be reviewed. At best, you will be paying 50p (compare to £80+ they may be asking on notice) as contribution to the electricity bills. Mine was quashed completely!

This is not a court matter (POPLA is an independent body) and hence no need to put in application.
An [Expensive] Immigrant journey has ended 19/08/2015. Good luck to you all out there...
