Do I need another extension ?

Hi Everyone,

I came to UK on Tier2 ICT in Dec 2010 and applied for Tier 1 General in April 2011. I was issued Tier 1 General in June 2011 for 2 years and then got an extension for another 3 years in 2013. So my Tier 1 is valid until June 2016 now.

My question is this .. since the time I spent on Tier 2 ICT doesn't count towards my ILR , I will be completing my 5 years ( ILR requirement period) in June 2016. If my Visa is valid until 15th June 2016 , what date can I apply for ILR and can I stay in UK legally if my ILR application is under processing. because if I can only apply for ILR after 15th June 2016 then that means on 16th June 2016 I will be in UK illegally as my visa expired on 15th June 2016. Does that mean I need to apply for another extension ??

I'm really confused and scared , can someone please clarify this.

You are fine mate. Apply within last 28 days of your visa expiry. If you do not get their decision by the day your visa expires, then too, you wont be an over-stayer. Your status will remain the same until the decision comes no matter how long it takes.
