My advice - find another law firm, a solicitor based firm not a immigration advice low level cmpany like this.

I just literally got off the phone with an immigration barrister. He is basically saying that at this point it will be a waste of money to get a specialist lawyer... At the minute the application needs a lot of evidence (work/friends/community groups/MP - letters) and a strong case cover letter explaining what happened... I could then involve the solicitors after this when I get stuck. He says discretionary leave would be my option right now! So confusing!!!

The trouble with any immigration case that is not a straight forward is there will be more than one route that can be followed. The barrister - has he she actually said what route you should apply for because FLR (o) & (FP) are both concessional routes...
As I said before IMHO FLR (FP) is the route you should pursue.
All the info you would gather as per the barrister said fits to that route. But do you know what to do with it??
Get a solicitor because time is against you.

But I've been told that FLR(FP) would not be a good option as I am single and have no children... So my private life is solely dependant on my work and friends...? He said to take the route of applying for DL using the FLR(O)

So the application went in and an acknowledgement has been sent back... Does anybody know how long it will now take to get a decision? My work gave me 4 weeks - such little time to sort things out... Am I able to find out from the HO roughly where I stand or how far they are with the processing so I can feedback to work with an estimated timescale? My MP kindly said they will write to the HO this week - do you think that will help at all or I'm just hoping for nothing? Thanks guys.

Just a little update. I was asked to submit my biometrics last week. I am guessing this is just standard procedure? It doesn't mean anything? Shouldn't get my hopes too high?!! I was just so happy to hear from them. The solicitors said to expect a 4-12 week wait for any kind of response or decision.

They are just making sure that it was you who really applied.

Regardless of the outcome biometrics are always taken. It is not indicative of success or failure for an application.
Your solicitor is giving you a very optimistic timescale for the decision. I think it is more like 8 to 20 weeks at the moment.

Outcome - a letter to the MP was sent saying I can work whilst this is going on... I received it two days ago.
Received a decision this morning, application refused but I was given a right of appeal. Phew!

We will appeal obviously. Question is, can I continue to work until a court decision? My employer doesn't know.

If I were you I would get the employer to assign a CoS to me, appeal for further consideration to a tribunal and make a note to consider application to issue Tier 2 Visa if they cannot Grant ILR.

From what I understand they have discretionary powers to allow this. Ask you Lawyer about resource under law or if you are just burning time and money.

Perhaps start making arrangements to move out of UK too...

Thank you Faelle. I think at the time my employer said that they exhausted the sponsorship - meaning I need an extended visa that does not require a new certificate. Atleast that's what I understood. However, They already gave me a letter to support this application stating that my job was a permanent job.

The solicitor seem to think that it was great news that I was given a right of appeal. She didn't think I would have that option. You may be right, maybe it is all just burning time and money... Having already lost so much - do I just give up and lose my house/job/life after 11yrs.......considering I've come this far trying to regularise my stay? That is the hard part.

I would have nothing after this. Would have to start from nothing. I am so depressed I am not sure I have it in me to keep going or any life left in me to start again... This was a stupid slip up and I will forever regret it. I still lie awake at night thinking why did I not get an ILR before...
