ILR Dependant Visa

Hi ,

My wife got her ILR last december and I am currently on Tier 2 Visa. I want to change to her dependant. Can you please let me know which form I need to fill and what are requirements for it?

Apply on form FLR(M) if you are currently in the UK.

You do realise this will reset your clock to zero and you will have to wait a further 5 years before you can apply for ILR. The time you have spent on Tier 2 will not count if you switch and will only count if you make a future application based on 10 years long residence.

Also, on FLR(M) there is a financial requirement and you need to meet level A1 English.

Yes, that is the form. The documents you require are listed in the form and the guidance notes.

If you have no children, the financial requirement to be met is £18,600pa. It goes up if you have children.

'Application for an
extension of stay in the UK
as the partner of a person
present and settled in the UK
or as a partner of a person with
refugee leave or humanitarian
protection and for a biometric
immigration document'

Also financial requirements have to be shown from my income or my wifes income?

In section 7.3A. There are 2 categories

Have you/your sponsor been in
employment with the same employer
and earning the amount specified in (xiv)
below continuously for 6 months prior to
the date of the application? (category A)

If you answered no at (iii), have you/
your sponsor been in other employment
in the 12 months prior to the date of
this application other than your or their
current employment? (category B)

My pay was increased in last december at my current job. So can I choose category A because it says earning the amount specified in (xiv) below continuously for 6 months prior to the date of the application? Or should I go for Category B. Also do I need to give last 6 or 12 months pay slips?
