if you applied for flr(m) after 9 july 2012, you will have to wait 5 years on flr(m) before you can apply for ilr.

I switched from Tier 4 to FLR(M) extension in November 2012 and received the BRP card in March 2013 which will expire in September 2015.

Can you please tell me which extension shall i apply for FLR(M) or Indefinite leave to remain in UK?

Please tell me soon, I shall be waiting for your reply.

My wife came to UK in Dec. 2010 on a Tier 1 dependent. Her Visa ran out before she completed 2 years. We applied for FLR(M) after 09-Jul-2012 and the leave was granted.

What is her status now? Can she now apply for ILR as she has completed her 2 years or she has to wait for 5 years as she applied for FLR(M) after 09-Jul-2012?

Your help will be much appreciated.

Ans: Old rules and providing she meets the requirements should be able to apply for set(m) now.

Indeed, I stand by what I said. If the applicant was a pbs dep prior to July 2012 and applied for FLR(M) [before the pbs dep leave expired] then the person would have transitional protection as per A280(c) and thus may apply for SET(M) as per 287(a)(i)(d).

However, you are saying you were not a pbs dep prior to July 2012 and thus no transitional protection.

Hi Amber,

I got my flr (m) last year and I spent two months out of country to visit my family.
Can you please tell me the period I can stay out of UK (For visit) if I want to extend my FLR (M).

I shall be looking forward to your reply.

Thanks,

Two months shouldn't be any issue. For SET(M) only absences of 6 or more months are requested so they'll not really look at it.

For SET(M), the question is:
Please provide details of any periods of absence of more than 6 months during that time.
I'll allow you to judge the interpretation of that.

Remember that they will have sight of your passport should there be any stamps showing absences.

Sure, I originally raised a different post for this question but when you were answering me on this post thus asked you same questions here.

I will close the duplicate post.

I would really appreciate your response on this question because I am not sure if I can travel any further or not :(

For Set(M) they only ask you to list absence of 6 months or more, i.e. single absence of that time period. If you are on holiday for 2 weeks, you are not required to list that but if you are in your home country for say 7 months, you need to list the absence.
