ILR Eligibility Check

Dear All,

I came to UK on Tier 2 ICT Visa for the first time in Feb 2010 for a week but then went back to India and came back in July 2010 for same sponsor and same client. I have been in UK since then and my first visa details are following:-

1) feb 2010 - feb 2011 - ICT Tier 2

Since then all my extensions have been in UK and I haven't been out for more that 180 days in full 5 years.

Can you please confirm if I am eligible for ILR in July 2015 on the basis of my first entry?

Thanks. My only concern is my entry in Feb 2010. Can that cause any problem? I was here only for a week and wasn't paid anything in UK due subsistence etc.

I really doubt your Eligibility for ILR in FEB 2015. The reason is, the total number of days you are out of the country should be less than 90 in any calendar year. (Qualifying Period)

On this, if you calculate, Between Feb2010 and July 2010, you were out by more than 90 days.

However, if you wait until June and apply, you do not worry about this and could possibly treat your July 2010 as the start of Qualifying period which should be fine.

Moderators, correct me if I am wrong.

July 2010 should be the start of your continuous period calculation.

Does your short break taken into account ?


I am in almost same situation but it is only employment out of Uk for 60 days.Tier1G.
