Tier 1 to Tier 2, again Tier 2 by diff sponsor, ILR query

Post by patelmilanb1 » Wed Feb 19, 2014 9:20 am

Hi All,

I have been granted tier 1 general in 2011 for 2 years. after that 2 years i switched in-country to Tier 2 general in 2013 working for XX company as software developer. Now the problem is, my current XX company is taking benefit of my current situation as they know that i am sponsored by them and can not leave company. they are not giving me any raise in my pay as agreed when i switched Tier 1 to tier 2. I am planning to leave XX and join YY company on tier 2 general (new company, new visa). is it possible that i will get my ILR?

14-06-2011 -> Granted Tier 1 General
10-06-2013 -> Made application to switch from Tier 1 to Tier 2 general within country
03-07-2013 -> Granted Tier 2 General for XX company
28-06-2016 -> expiring Tier 2

ILR 5 years (is it possible to get my ILR in this situation)
28-06-2016 to 27-06-2015 -> 5th year
27-06-2015 to 26-06-2014 -> 4th year
26-06-2014 to 25-06-2013 -> 3rd year
25-06-2013 to 24-06-2012 -> 2nd year
24-06-2012 to 23-06-2011 -> 1st year

Now, If i change my employer to YY say in Jun-2014, i will get a new Tier 2 general visa for YY company.. in this case will i be eligible for ILR and from when my ILR period starts and ends?

Please advice

You can change jobs as many times as you want under tier 2 and still qualify for ILR after 5 continuous years in the UK, provided you meet the £35000 salary or be doing a job in the shortage occupation in 2016.

Yes, if the rules remain as they are.

Hi Patel,

I am also planning switch into Tier 2 from Tier 1 General, could you please advice on below points.

1. Can i show required salary as per the SOC Code ?
2. Presently i am working with the employer, in the COS form employer need to enter start of of employment, so do i need to show future date or the date i have joined with this company?
3. what mode you applied for switching(By post or In person)

Much appreciated if you could share your experience.

Thanks
