judicial review guys help

hi. i would like to know about immigration status when after UT refused my appeal i want to apply for judicial review.

My case history is as follows:
1.Applied Tier1 Entrepreneur in July 2013 -PSW £50000 Third Party Sponsor.
2.was refused T1 ENT on the basis that i couldn't provide bank letter for third party in SEPTEMBER 2013
3. Appealed against the decision and hearing was on 3rd Sept 2014
4. Appeal got rejected on 8 September
5. Finally got letter on 15 feb after following various appeal procedures that all my appeal rights are exhausted.

my question now is
1. Can i apply for Judicial Review and whats would be my status during JR and
2. will i be eligible to work during this process
3. Would i be considered as an Overstayer at any point of time?
4. i will complete 10 years continuous leave in October 2015 and will JR count towards my 10 year period?

Please guide me on my options as soon as possible.
