I have a question.
Can I apply for a visa as a person exercising rights of access to a child resident in the United Kingdom under the section 248A Immigration Rules ? I am currently waiting for a spouse visa and am wondering if I can apply for the first mentioned above after I get a spouse visa.
According to the Immigration Rules, the requirement is that 'the applicant has limited leave to remain in the United Kingdom as the spouse, civil partner, unmarried partner or same-sex partner of a person present and settled in the United Kingdom who is the other parent of the child'.
Looks like I can apply for this type of visa once I hold a spouse visa. But I am not sure.
I am confused by the fact that I have read somewhere the applicant can apply to get this type of visa when hi/she separetes from his/her patner and has a child...
Please, can you help me to understand it who knows !!
