FLR(FP) - no Passport (destroyed) - will a DL suffice?

I know someone who needs to make a FLR(FP) application on the basis of their British partner and children. They came into the UK many years ago on their non-EEA passport with a valid EC visa, but unfortunately it was later damaged and destroyed. However whilst it existed they submitted it to DVLA to obtain a Driver's Licence. Hence they now have an original DL as ID but no passport. Is this going to be a problem for them making the FLR(FP) application? This will be under section EX. as they are a long term overstayer. Hopefully it should be possible to obtain a copy of the passport from DVLA. Many thanks for any advice.

Almost in a similar position passport expired too appearantly there should be at least 6 months validity upon application. I would also like more info on this, as any alternative eoulbe awesome.
