When to apply for Extension to visa (Pre July 2012)

Spouse/ CP Visa applied on 13.06.12

Visa valid from 17.11.12
visa valid until 17.02.15

entered uk 07.12.12

Has NOT passed the LiUK test so will need to apply for an extension.
When do they have to apply?

Can apply between now and before the expiry of the visa using form FLR(M).

In the form do i fill in sections 7a and 7b.
I presume its just 7b as applied for visa before 9.07.12 so financial should be irrelevant?
Can someone please confirm.

If you applied before July 2012 you will be under the old rules. Go straight to section 7B Maintenance.

Section 7A - Financial requirement
If you were granted leave to enter or remain as a partner following an application made before 9th July 2012, excluding leave as the partner of a Relevant Points Based System Migrant, you are not required to complete section 7A, proceed to 7B MAINTENANCE. For more information on completing the financial requirement section please see section 21 of the guidance notes.

Sorry for raising an old topic but Ive been told that financial and ENGLISH TESTS do not apply as its before july 2012.

Is there any truth in this? thanks

Financial requirements also apply but under the old rules, they were known as having to adequately maintain yourself without recourse to public funds. More info here.
